Terms of Use

These Terms of Use (the “Terms”) govern access to and use of the HostCal platform (the “Service”). By creating an account or using the Service you agree to these Terms. If you do not agree, do not use the Service. HostCal is a business-to-business tool for owners and managers of short-term rental properties.

1. Acceptance of the terms

By registering for, accessing, or using the Service, you confirm that you have read, understood, and agree to be bound by these Terms and by our Privacy Policy. If you use the Service on behalf of a company, you represent that you are authorised to bind that company to these Terms.

2. The service

HostCal provides revenue-intelligence, calendar, reservation, intervention, and invoicing tools for short-term rental properties. Features may evolve over time; we may add, change, or remove functionality to improve the Service, and will give reasonable notice of material changes that adversely affect paid features.

3. Accounts & eligibility

You must provide accurate account information and keep it up to date. You are responsible for safeguarding your credentials and for all activity under your account. You must be at least 18 years old and legally able to enter into a contract. Notify us promptly of any unauthorised use of your account.

4. Acceptable use

You agree not to misuse the Service: no unlawful, infringing, or fraudulent activity; no attempts to breach security, access other tenants' data, reverse-engineer, scrape, or overload the Service; and no uploading of malicious code. You are responsible for ensuring the data you enter (including guest data) is collected and used lawfully.

5. Subscription & fees

Paid plans are billed in advance on a recurring basis at the rates agreed at sign-up or in your order. Unless stated otherwise, fees are exclusive of applicable taxes and are non-refundable except where required by law. We may change pricing with reasonable prior notice effective at your next renewal.

6. Your data

You retain all rights to the business data you enter into the Service. You grant HostCal the limited right to host and process that data solely to provide and secure the Service. Our handling of personal data is described in the Privacy Policy. You can export your data or request account deletion at any time from Settings › Profile › Data & privacy.

7. OTA synchronization

If you enable OTA sync (“Synchronisation OTA”), you authorise HostCal to exchange availability and reservation data with the booking channels you connect, on your behalf, to keep your calendar accurate. You are responsible for your own agreements with those channels and for the accuracy of the connections you configure.

8. Intellectual property

The Service, including its software, design, and content (excluding your data), is owned by HostCal and protected by intellectual-property laws. We grant you a limited, non-exclusive, non-transferable right to use the Service during your subscription. You may not copy, resell, or create derivative works from the Service.

9. Warranties & disclaimers

The Service is provided “as is” and “as available”. To the maximum extent permitted by law, HostCal disclaims all implied warranties, including merchantability and fitness for a particular purpose. Revenue figures, forecasts, and insights are indicative and do not constitute financial or legal advice.

10. Limitation of liability

To the maximum extent permitted by law, HostCal is not liable for indirect, incidental, or consequential damages, or for lost profits or data. Our total aggregate liability arising from the Service is limited to the fees you paid for the Service in the twelve months preceding the event giving rise to the claim.

11. Suspension & termination

You may stop using the Service and delete your account at any time. We may suspend or terminate access if you materially breach these Terms or use the Service in a way that risks harm to others or to the Service. Certain records (such as invoices and audit logs) are retained after account deletion as described in the Privacy Policy.

12. Changes to these terms

We may update these Terms from time to time. When we make material changes we will update the “last updated” date and, where appropriate, notify you. Continued use of the Service after changes take effect constitutes acceptance of the revised Terms.

13. Governing law

These Terms are governed by French law. Any dispute relating to the Service will be subject to the jurisdiction of the competent courts, without prejudice to any mandatory consumer-protection provisions that may apply to you.
